H1B Jobs | H1B Visa Transfer Companies | H1B Consultants | H1B Employers

What is an H1b transfer?

This is a process of converting one’s H1B work visa from one employer to a new sponsor. It involves various steps this can be done only if the candidate has an existing H1B petition with a current or past employer.

An employer can petition for an H-1B transfer to the USCIS on behalf of a candidate any time in the year and this is not subject to any quota. A candidate can transfer and start working for the new employer once the H-1B transfer has been approved by the USCIS.

If USCIS approves the H-1B transfer, your present employer needs to be notified. Note that there is no necessity of getting a no objection certificate from the previous employer for the H1B transfer.

You can join and start working for the new employer any time after USCIS approves the H-1B transfer and you could work until the H-1B visa expiration date (as per your LCA).

Quantum Infotech, Inc. H1B Transfer Process

The most important step of H1-B transfer process is to find a project. Based on the educational qualifications and experience of the candidate, Quantum will find a project for the candidate before initiating the H1B transfer.

The LCA process takes 7 (Seven) days, during this period we obtain documents from you to initiate H1B Petition with the USCIS. We will send the completed H1B Visa Petition package to USCIS immediately upon approval of LCA via over-night delivery. A Green Card is the official card issued by the US Immigration Service (USCIS) to foreign nationals granting them permanent residency in the USA. A Green Card allows you to live and work in the United States of America. It is officially called Form I-551, the Permanent Resident Card. Green Card holders are known as ‘Lawful Permanent Residents’ of the USA (‘Immigrants’).

There are multiple ways to obtain a so-called US Green Card (permanent residence). One way is through a family member. The other way is to obtain Green-card is Employment-based Green Card.

EB-1: These visas are designed for certain international executives and managers; outstanding professors and researchers; and those who have extraordinary ability in the sciences, arts, education, business or athletics.

EB-2: This category is for foreign nationals professionals with an ‘advanced degrees’ (masters degree or higher) and with a job offer from a U.S. company; for foreign nationals with ‘exceptional ability’ in the sciences, business or arts and with a job offer from a U.S. company; and for foreign nationals with exceptional ability, or an advanced degree, who can show that their activities will substantially benefit the U.S. national interest. 4 years Bachelors degrees with 5 years of working experience are also eligible.

Perm & Employment Based Green Card Application Procedure

First you join a company and you are introduced to the attorney, she/he sends a questionnaire to see which criteria you fit best.Once the category is determined then the attorney with the consultant’s qualification tries to get job order and wage determination approved.

What Is Job Order & Wage Approval?

Job Order- This is to see whether the consultant fits the job with the required skills. We need to place this on Department Homeland Security website and we need to post this in our company board for people to look at this posting. This needs to be posted for at-least 60 days.

Wage approval- With the qualification, skills and number of years experience the USCIS- has criteria to match and approve the wage that the candidate can be well suited. That means the company should offer him salary per year.

TN Visa For NAFTA Professional

What is TN Visa?
The TN (Treaty National) visa was created under the North American Free Trade Agreement (NAFTA) between Canada, United States and Mexico. It creates special economic and trade relationships between the North American Countries. The (TN) visa allows citizens of Canada and Mexico to work in the United States in certain positions listed under NAFTA.

There are two different types of TN status, a TN-1 for Canadian professionals and a TN-2 for Mexican professionals. This TN visa category is a viable alternative for Canadian and Mexican professionals seeking to work on a temporary basis in the United States. Moreover, they may also work for a Canadian or Mexican company in the U.S. when those companies are engaged in projects with U.S. based companies.

It is important to note that there are slight differences between the requirements for each TN category. The main difference is that a Mexican national must obtain a TN visa stamp from a U.S. consulate before they can enter the United States while Canadian professionals can apply for their visa stamp directly at the border. Mexican citizens, however, are not required to file a petition with the USCIS before seeking their visa at a consulate.

  • The position in the United States must requires a NAFTA professional
  • Applicant must have a prearranged full-time or part-time job with a U.S. employer and must have a job offer Letter from an employer who is willing to file the application on his behalf. In fact, the employer is called the “Petitioner” and applicant, the employee, is called the “Beneficiary.”
  • Applicant must ensure that he meets the specific requirements for the TN occupation. He must prove that he qualify for the Minimum Education Requirements or Alternative Credentials of the TN occupation for which he is applying. This means he must have a Baccalaureate or Licenciatura degree in a field related to the occupation, although some only require 5 years of relevant work experience.

What Is USA H1B Visa ?

We at Quantum Infotech decided to put together a quick primer on what basically H1B Visa Is? And how our professional services helps and guides you through this process.

What is H1B Visa
The H-1B is a non-immigrant visa in the United States that allows US employers to temporarily employ (sponsor) foreign workers in specialty occupations. If a foreign worker in H-1B status quits or is dismissed from the sponsoring employer, the worker must either apply for or be granted a change of status to another non-immigrant status, find another employer or leave the US.

H1B Visa Requirements
To qualify for an H1B visa to work in the US, a foreign worker must have a temporary offer of employment in a specialty occupation from a US employer.
A specialty occupation is an occupation that requires theoretical and practical application of specialized knowledge that usually requires the equivalent of at least a bachelor's degree or equivalent work experience. Typical specialty occupation fields include architecture, engineering, mathematics, physical sciences, medicine, health, education, business specialties, accounting, law, theology and the arts. Fashion models of distinguished merit and ability may also qualify for an H1B visa.

Authorization is strictly limited to employment by the sponsoring employer only. If the worker wants to change companies, the new employer would need to apply for a transfer and request to become the worker’s new sponsor H1B visa applicants may also be required to meet certain health and character requirements.

H1B Visa Entitlements
An H1B visa entitles the holder to live and work in the US temporarily. An H1B visa is usually granted for an initial period of 3 years and extensions may be granted. Foreign workers with an H1B visa are permitted dual intent, meaning the applicant can maintain H1B visa status while applying for a Green Card to remain in the US permanently.
Spouses and unmarried children under 21 years of age may apply for the applicable derivative visa (H4 visa) to join their spouse or parent in the US. Accompanying spouses and children are entitled to study in the United States but are not entitled to undertake any employment without obtaining an appropriate work visa.

Important Highlights
The US immigration legislation caps the number of H1B visas issued to 65,000 per fiscal year (from October 1 to September 30). The United States Citizenship and Immigration Services (USCIS) starts accepting applications on the first business day of April for visas that count against the fiscal year starting in October. If there are more applications than available visas, there is a lottery system that decides whose application makes it through for that year

What candidates need to know if transferring your H-1B visa to a consulting or staffing company?

  • The company is reputable and has a high h1b visa approval rate (and is not blacklisted).

  • The company’s policy if you go on the bench or your project ends. Some US consulting companies immediately terminate your employment if they can’t find you a project and you risk going out of status if this happens.

  • Clarify if the company will extend your visa when it expires and if they will process your greencard if you wish to do so and how soon it will start the process.

The Top ten benefits of outsourcing IT through managed services

Immediate benefits can be gained by outsourcing IT services through Managed Services.

1. Control IT Costs
Outsourcing converts fixed IT costs into variable costs and allows you budget effectively. In other words, only pay for what you use when you need it.

2. Reduce Labor Costs
Hiring and training an IT staff can be very expensive, and temporary employees don't always live up to your expectations. Outsourcing lets you focus your human resources where you need them most.

3. Trained, Experienced, Qualified, And Certified.
If you’re not IT trained, how do you assure an employee is qualified? Certifications like Microsoft Certified Systems Engineer (MCSE) are important, but so is experience.

4. Qualified doesn’t Equal Experienced
Few problems are new for leading IT service companies, which see related problems multiple times. An in-house IT employee leads an isolated existence no matter how much they train. We'd all rather an experienced doctor; the same is true for IT.

5. Increase Efficiency and Competitiveness
Organizations that try to do all IT Services in-house themselves can have much higher research, development, and implementation time, all of which increase costs and are ultimately passed on to customers.

6. Quickly Implement New Technology
A quality outsourced IT service organization will have the resources to start new projects right away. Handling the same project in-house might involve weeks or months to hire the right people, train them, and provide the support they need. For most implementations, quality IT companies will bring years of experience in the beginning saving time and money.

7. Stay Focused on Your Core Business
Businesses have limited resources, and every manager has limited time and attention. Outsourcing can help your business stay focused on your core business and not get distracted by complex IT decisions.

8. Reduce risk
Every business investment carries a certain amount of risk. Markets, competition, government regulations, financial conditions, and technologies all change very quickly. Outsourcing providers assume and manage much of this risk for you, with specific industry knowledge, especially security and compliance issues. They generally are much better at deciding how to avoid risk in their areas of expertise.

9. Level the Playing Field
Most small businesses can't afford to match the in-house support services that larger companies maintain. Outsourcing can help small companies act "big" by giving them access to the similar technology, and expertise that large companies enjoy. An independent third party managed cost structure and economy of scale can give your company a competitive advantage.

10. Compliance and Security
Is your firewall up to date? Do you have a DMZ installed? Do you audit your Workstations and Servers? Has your company implemented PCI security standards and work to maintain those standards? For example, Businesses have more ways than ever to prosper by taking many forms of payments such as Credit and Debit Cards, Gift Certificates, E-Checks, Wire Transfers to name a few, but with these forms of transacting also comes the need for due diligence. By outsourcing a qualified Manages Services company who is familiar with PCI Compliance standards, you can rest assured that your company is minimizing the risks associated with maintaining client data, credit card numbers, sensitive competitive information and more
